1:1 Coaching Terms and Conditions

Welcome to our online fitness coaching service (the "Service"). By using the Service, you agree to be bound by these terms and conditions (the "Terms"). If you do not agree to these Terms, please do not use the Service.

Scope of Service

The Service provides online fitness coaching and education through a personalized program designed for you based on your fitness goals and preferences. The Service includes access to fitness assessments, workouts, nutrition guidance, and other resources as determined by your coach. 

Eligibility

To be eligible to use the Service, you must be at least 18 years old and in good physical health. You should consult with a medical professional before starting any new exercise program. By using the Service, you represent and warrant that you are physically and medically able to participate in the exercises and activities provided through the Service.

Payments and Refunds

The Service is offered on a subscription basis, with fees due on a monthly or annual basis as set forth on the Service's website. If you choose to cancel your subscription, your access to the Service will end at the end of the current subscription period. In the event you decide to cancel your Services and no longer wish to use them, you must do so 48 hours in advance of the scheduled Session in order to receive a refund. If you purchased bundled Services for a discount, you will forfeit the free Session if any Sessions have already been held. You do however have the right to transfer the Services to someone you know as long as you provide this notice to us in writing over email. Email notifications should be sent to support@glamourbodyfitness.com.

Intellectual Property

The Service, including all content and materials provided through the Service, such as text, images, graphics, and software, is the property of Glamour Body Fitness LLC or its licensors and is protected by copyright and other intellectual property laws. You may not use any content or materials on the Service for any commercial purpose without the express written consent of Glamour Body Fitness LLC.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. Glamour Body Fitness LLC makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service. Glamour Body Fitness LLC will not be liable for any damages of any kind arising from the use of the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Limitation of Liability

Glamour Body Fitness LLC will not be liable for any damages of any kind arising from the use of the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Governing Law

These Terms and your use of the Service will be governed by and construed in accordance with the laws of the State of South Carolina, without giving effect to any principles of conflicts of law.

Changes to the Service and These Terms

Glamour Body Fitness LLC reserves the right to change or modify the Service or these Terms at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting on the Service. Your continued use of the Service after any such change or modification constitutes your acceptance of the new Terms. It is your responsibility to regularly review the Terms.

Miscellaneous

These Terms constitute the entire agreement between you and Glamour Body Fitness LLC and govern your use of the Service. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent possible and the remaining provisions will remain in full force and effect. The failure of Glamour Body Fitness LLC to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Service or these Terms must be filed within one year after such claim or cause of action arose or be forever barred. The section titles in these Terms are for convenience only and have no legal or contractual effect.

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Glamour Body Fitness LLC without restriction.

Glamour Body Fitness LLC may provide you with notices, including those regarding changes to these Terms, by email, regular mail, or postings on the Service.

Any disputes arising under or in connection with these Terms or the Service will be resolved through binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such arbitration will take place in Spartanburg, South Carolina. The parties will appoint an arbitrator mutually acceptable to both parties. If the parties are unable to agree on an arbitrator, the American Arbitration Association will appoint one. The arbitration will be conducted in the English language. The arbitration will be confidential, and the arbitration proceedings, including the award, will be kept confidential by the parties and the arbitrator except as may be required by law. The arbitration award will be final and binding upon the parties.

These Terms and the relationship between you and Glamour Body Fitness LLC] will be governed by the laws of the State of South Carolina without regard to its conflict of law provisions. You and Glamour Body Fitness LLC agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Spartanburg, South Carolina.

Any failure by Glamour Body Fitness LLC to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.
